Following the running of Race 4, Ferrymead Restaurant & Bars Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr M J Howard, alleging a breach of the push-out rule
| -- DECISION AND REASONS: --Following the running of Race 4, Ferrymead Restaurant & Bars Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr M J Howard, alleging a breach of the push-out rule in that Mr Howard, as the driver of FAR FROM GRACE, moved FRANCO NIGHTRIDER (R D Holmes) wider on the track with approximately 1100 metres to run. ----Mr McIntyre showed the incident on video replays of the race. He pointed out Mr Howard racing one off the fence and Mr Holmes behind him in the 3-wide line. As the field progressed to the 1100 metres, Mr Howard came out. It was clear, Mr McIntyre submitted, that Mr Holmes was, at that point, outside Mr Howard and progressing forward and was forced to race wider on the track. ----Mr McIntyre told the Committee that Mr Howard had no previous breaches of the push-out rule on his record. He recommended a fine of $200. ----Mr Howard stated that he was not in a position to pay a fine. He was therefore suspended for a period up to and including 11 August 2005, effectively 3 days. ----JUDICIAL COMMITTEE ------ -- |
