DECISION AND REASONS:
--Following the running of Race 9, KB’s Bakery Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Public Trainer, Mr G T Court, alleging a breach of Rule 864 (2) (d) in that “the earplug cord on BAD ALL OVER (trained by Mr Court) detached and the earplugs we re unable to be activated”.

Mr P T Court, Licensed Open Horseman, as agent for Mr Court, had signed the Statement by the Defendant on the information form indicating, firstly, that Mr Court admitted the breach of the Rule and, secondly, that Mr Court did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Mr Ydgren advised that Mr Court had not breached the Rule in the past 12 months and recommended a fine of $100.

Mr Court was fined the sum of $100.
