Following the running of Race 1, the Wilson's TAB & Sports Bar Mobile Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr S. G. Dickson, driver of Bobecket (2), alleging a breach of Rule 869(3)(b)

DECISION AND REASONS:

--

Following the running of Race 1, the Wilson's TAB & Sports Bar Mobile Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr S. G. Dickson, driver of Bobecket (2), alleging a breach of Rule 869(3)(b). The charge was that Mr Dickson drove in a careless manner in that he allowed his horse (Bobecket) to move in and strike "Kilburnie Bricriu" causing that horse to gallop.

Mr Dickson had indicated on the information that he admitted the breach of this Rule and he confirmed this at the hearing.

Video coverage of this incident was shown and it illustrated the matters referred in the charge.

Mr Dickson explained that his horse had moved inwards when he was moving forward, which resulted in the interference.

In relation to penalty Mr McIntyre advised that Mr Dickson had a previous conviction for a similar breach on 24 April 2005, which was almost a year ago. Mr McIntyre said that Mr Dickson should be given credit for his guilty plea. A fine of $300-00 or a two day suspension was recommended.

Mr Dickson advised us that he would prefer a suspension to a fine.

Having heard the submissions on penalty we took into account Mr Dickson's guilty plea. We chose to ignore the previous conviction as it was only three days inside the 12 month period. As Mr Dickson preferred a suspension to a fine he was suspended from driving from after the conclusion of racing on 21 April 2006 until after the conclusion of racing on 28 April 2006, this being a two day suspension.
