Decision: Following the running of Race 6 the Peter Diver Plumbing & Drainage Ltd Mobile Pace, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr S. J. Thompson, the driver of MISS CHIEVOUS (11), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively

Following the running of Race 6 the Peter Diver Plumbing & Drainage Ltd Mobile Pace, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr S. J. Thompson, the driver of MISS CHIEVOUS (11), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively in the run home.

Mr Thompson is a Junior Horseman but advised that he did not need assistance.  He had indicated on the information that he admitted this breach of the Rules and he confirmed that at the hearing.

Video coverage of this incident was shown to illustrate that Mr Thompson had used his whip on about 20 - 21 occasions in the run home, and in doing so was in breach of the Rules.  Mr Thompson said that he did not hit the horse on every occasion, but agreed that he was aware of the whip guidelines.

Penalty:

In relation to penalty Mrs Williams advised that Mr Thompson had no previous convictions, and that a fine of $200-00 would be appropriate.  Mr Thompson said that he thought that a fine of $200-00 was excessive as he did not have a lot of drives.  The possibility of a suspension as an alternative to a fine was raised, but Mr Thompson said that he would prefer a fine.

I took into account the submissions made by both parties. In determining an appropriate penalty I took into account that Mr Thompson had no previous convictions and had admitted the breach. I was satisfied that a fine of $200-00 was appropriate in these circumstances. Accordingly Mr Thompson was fined the sum of $200-00.
