DECISION AND REASONS:
--Following the running of Race 8, the McGrouther Veterinary Clinic & Labs Pace, an Information Instigating a Protest was laid by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 869(8) by "Ernestlordrutherford" (5) which finished in 4th place. Mr A. J. McPherson, the trainer and driver of "Ernestlordrutherford", did not attend this hearing and he had written on the information "I don?t contest" the protest.
--Mr Ydgren used video coverage of the incident to show that "Erenestlordrutherford" had just taken the lead at about the 900 metre mark when it raced erratically severely affecting the chances of four of the following horses. The most severely affected horse was "Steffi Graf" (7) which finished in 11th place. Mr McIntyre asked that "Ernestlordrutheford" be relegated to 11th place behind "Steffi Graf?.
--The protest was upheld and "Ernestlordrutherford" was relegated to 11th place. The amended places are as follows.
