DECISION AND REASONS:

Following the running of Race 2 an information was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of the "lapped on" rule, Rule 870(5), by Our Fred (7) driven by Mr T. Woodward. Mr Woodward and the trainer of the horse, Mr B. Lilley, also attended this hearing.

Video coverage of the race was used to show that Our Fred finished in 4th place at which time it was in a break. At that time Our Fred was lapped on by the 5th, 6th, 7th and 8th horses.

After viewing the video coverage of this incident the connections of Our Fred did not contest the protest. Accordingly Our Fred was relegated to 8th place. The amended places are as follows.
