Following the running of Race 2, the Robbie's Bar & Bistro Rangiora Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr T. S. Chmiel, the driver of OK Otto (16), alleging that he had committed a breach of Rule 869(2)(a)
| -- DECISION AND REASONS: --Following the running of Race 2, the Robbie's Bar & Bistro Rangiora Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr T. S. Chmiel, the driver of OK Otto (16), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively. --Mr Chmiel had indicated on the information that he admitted this breach of the Rule and he confirmed this at the hearing. ------Mr Escott gave evidence that Mr Chmiel was seen to use the whip on his --horse on about 21 occasions in the run home. The video coverage confirmed this evidence. --Penalty: Mr Escott advised that Mr Chmiel had no previous relevant convictions and recommended a fine of $200-00. Mr Chmiel said that he considered that a fine of this amount was too much. --We considered the matter of penalty and were satisfied that the amount recommended by Mr Escott was in line with other penalties imposed for like offences in the same circumstances. Mr Chmiel was therefore fined the sum of $200-00. --Chairman ----
