Decision:

Following the running of Race 8, Sydenham Bakery (424 Colombo Street) Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Driver, Mr R D  Holmes, alleging a breach of Rule 869 (2) (a) in that Mr Holmes “as the driver of M J FULHAM used his whip excessively in the home straight”.

Following the running of Race 8, Sydenham Bakery (424 Colombo Street) Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Driver, Mr R D  Holmes, alleging a breach of Rule 869 (2) (a) in that Mr Holmes “as the driver of M J FULHAM used his whip excessively in the home straight”.

Mr Holmes had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.

Rule 869 (2) (a) provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.

Mr Ydgren stated that the Stipendiary Stewards were alleging that Mr Holmes had used his whip 20 times in the run home, which was excessive. He showed a video replay of the final 300-400 metres of the Race. He pointed out Mr Holmes on M J FULHAM on the extreme outside of the field. It was observed that Mr Homes had used the whip continuously without any distinct pauses or interruption by acceptable alternative actions over the final 200 metres of the Race.

Mr Ydgren said that Mr Holmes had freely admitted to the Stewards that he had breached the Rule. Mr Holmes had a clear record as far as breaches of the whip Rule were concerned. Mr Ydgren recommended a fine of $200.

The Committee took into account Mr Holmes admission of the breach and his previous good record.

Mr Holmes was fined the sum of $200.
