Information No. 68193 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainers, Messrs M Purdon & G R Payne, alleging a breach of Rule 865 (4) in that, as the trainers of KOTARE MACH, a runner in Race 4, they “failed to notify that this horse would race with removeable earplugs on”.
Information No. 68193 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainers, Messrs M Purdon & G R Payne, alleging a breach of Rule 865 (4) in that, as the trainers of KOTARE MACH, a runner in Race 4, they “failed to notify that this horse would race with removeable earplugs on”.
Mr M Purdon had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
Rule 865 provides as follows:
(4) The trainer and/or person in control of a horse shall present such horse in the assembly area with the same or identical gear, or with such different gear as has been notified as required by the foregoing provisions of this Rule.
Mr Renault informed the Committee that KOTARE MACH, trained by Messrs Purdon & Payne, had been been presented to race in Race 4 wearing removeable earplugs that had not been notified as required. Mr Renault recommended a fine of $100.
--Messrs Purdon & Payne were fined the sum of $100.
