As Mr Lethaby has admitted the charge, it is therefore deemed to be proved.

Penalty:

Mr Lethaby is suspended from driving for 3 days. Those days will encompass meetings at NZ Metropolitan Trotting Club on 26th October, Kaikoura 29th October and NZ Metropolitan Trotting Club on 2nd November  2012.

Charge:

It was alleged that Mr SD Lethaby, Open Horseman, ("Lee Van Cleef") drove carelessly near the 1000 metre mark shifting inwards when not clear of "Lively Tintara" (M Edmonds) causing "Lively Tintara" to break and lose its chances.

Facts:

The Stipendiary Stewards and Mr Lethaby agreed that the evidence adduced in the protest hearing could be utilised for the hearing of this charge. The fact situation is encapsulated in the charge details above, and was not contested by Mr Lethaby. He allowed his horse to move inwards when not sufficiently clear of "Lively Tintara" which broke from its gait and galloped for some distance, eventually finishing 10th in a field of 11 runners. 

Submissions for Penalty:

The Stipendiary Stewards advised the hearing that Mr Lethaby had a clear record for the previous 12 months, but having said that, they noted that Mr Lethaby was not a "busy" horseman, having had only 3 drives in the current season.

It was observed that the Penalty Guide provided for  a penalty of a fine of $500 or suspension for 10 drives. The hearing was also advised of a very similar case which had been heard at Timaru on 14th October where a horseman of a similar background received a 3 day suspension.

Mr Lethaby submitted that his preference was to be suspended. He did not request a deferral of the period of suspension.

In this case the Judicial Committee was of the view that a suspension was appropriate. Mr Lethaby's actions caused his horse to be relegated which cost the owners a stake of $535.
