DECISION AND REASONS:

Following the running of Race 6, Paul Renwick Kitchen & Joinery Centre Free-For-All Trot, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against SOME DIRECTION (J W Smith), placed 1st by the judge, on the grounds of interference to GLENBOGLE (M P Jones), placed 3rd by the judge, in that "SOME DIRECTION forced GLENBOGLE to race wider on the track with approximately 1600 metres to run".

Mr Smith, the driver, co-trainer and part-owner of SOME DIRECTION, represented the connections of that horse at the hearing of the information.

Mr M P Jones stated that he was racing 2nd or 3rd last. ZURI had been in front of him and 3-wide for most of the race and Mr Jones decided to go forward at that point and get onto ZURI's back. Mr Jones said that, as he went forward, Mr Smith came out in front of him and forced him to race 4-wide for a short distance. He believed that he was outside the sulky wheel of SOME DIRECTION when that horse came out. Mr Jones, when asked by the Committee to what extent his chances were affected, replied that the whole race changed for him when Mr Smith was able to get out in front of him.

Mr B D Williams, Assistant Stipendiary Steward, showed the incident on video replays.

Mr Smith stated that Mr Jones was "coming forward at speed" and that he, Mr Smith, had come out in front of him. Mr Jones was on a forward and outward movement at the time which

resulted in GLENBOGLE racing wider than it otherwise would have. Mr Smith submitted that GLENBOGLE had raced wider for only a very short distance and had immediately got back onto his back.

Mr McIntyre described the situation as a "marginal call" and pointed out that Mr Jones had got immediately onto the back of SOME DIRECTION.

The Committee, after a consideration of all of the evidence including the video footage, was not satisfied that there had been a breach of the push-out rule as alleged. Accordingly, the protest was dismissed and placing for the Race stand.
