DECISION AND REASONS:

Following the running of Race 4, Miss Dior Cherie Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr C L E Kennett, alleging that SHEZA BELMER driven by Mr Kennett "struck the sulky wheel of WAIKARI ON (K M James) resulting in SHEZA BELMER tangling with resultant checks to HOPEFULL and QUICK ATOM".

Mr Kennett was present at the hearing of the information and admitted the breach. The charge was found proved and the hearing proceeded in relation to penalty.

Mr B D Williams, Assistant Stipendiary Steward, showed video replays of the incident. He pointed out WAIKARI ON being followed by SHEZA BELMER with approximately 700 metres to run. At that point, he pointed out WAIKARI ON shift out and, as Mr Kennett tried to shift out and take up a position on that horse's back, he appeared to strike the sulky wheel of WAIKARI ON, tangle and go back onto HOPEFULL which "lost momentum and several lengths". QUICK ATOM, which was following HOPEFULL, broke and its chances in the race were extinguished.

Mr McIntyre pointed out to the Committee that the race was for a stake of $20,000 on a Premier Night. Two runners had had their chances extinguished as a result of Mr Kennett's actions. He asked the Committee to take into account Mr Kennett's admission of the breach.

Mr Kennett has been a senior driver for many years and has a clear record, Mr McIntyre said. Mr McIntyre recommended a period of suspension of up to 3 days.

Mr Kennett admitted that he had made a "misjudgement" and did not wish to say anything further in relation to the incident or penalty.

The Committee considered the submissions of Mr McIntyre and the video evidence and took into account Mr Kennett's frank admission of the breach and his previous good record. The Committee suspended Mr Kennett's horseman's licence for a period up to and including Friday, 2nd June 2006.
