DECISION AND REASONS:
--Following the running of Race 7, Crichton Horne & Associates Limited NZ Junior Drivers' Championship (Heat 3), an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr P L Hilliard, alleging that Mr Hilliard "drove carelessly when allowing his horse MIDNITE to strike the wheel of FRONT PAGE GIRL and subsequently causing CHRISTIAN FIRE being moved wider on the track".
----Mr Hilliard was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.
----Mrs K L Williams, Stipendiary Steward, showed a video replay of the incident which occurred with approximately 1200 metres to run. She pointed out Mr Hilliard on MIDNITE, racing in the one-one, hit the wheel of FRONT PAGE GIRL when coming out looking for a run causing his horse to break resulting in CHRISTIAN FIRE, which was improving 3-wide, being pushed 4-wide. Mrs Williams alleged that it was also a "technical breach" of the pushout rule.
----Mr Hilliard accepted Mrs Williams' version of the incident.
----Mrs Williams recommended a fine of $200. Mr Hilliard had had 118 drives for 6 wins, Mrs Williams said. He had held a licence for two seasons. It was an error of judgement rather than a deliberate breach. Mr Hilliard advised the Committee that he had not previously been charged with a driving offence. He indicated that he was in a position to pay a fine and preferred a fine to a suspension.
--The Committee noted Mr Hilliard's previous good record and his frank admission of the breach.
----Mr Hilliard was fined the sum of $200.
