Following the running of Race 5, The Rock Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Holder of Licence to Train, Miss A E Puha, alleging a breach of Rule 864 (2) (d) in that Miss Puha, as the trainer of PRECIOUS AMRIK in the Race, “failed to attach the boring pole as not to come adrift on PRECIOUS AMRIK”.



DECISION AND REASONS:

Following the running of Race 5, The Rock Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Holder of Licence to Train, Miss A E Puha, alleging a breach of Rule 864 (2) (d) in that Miss Puha, as the trainer of PRECIOUS AMRIK in the Race, “failed to attach the boring pole as not to come adrift on PRECIOUS AMRIK”.

Mr R G Tirikatene, the husband of and the person in control of the horse for Miss Puha, was present at the hearing of the information and admitted the breach on behalf of Miss Puha. The charge was found proved accordingly.

Rule 864 provides as follows:

--

(2)       Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse  ensure that:-

--

         (d)  all gear is correctly applied and/or affixed so as not to malfunction or come adrift.

--

Mr Renault stated that, in Race 5, it was observed by the Stipendiary Stewards that the boring pole on PRECIOUS AMRIK had become detached from the bridle but was still attached to the saddle and hanging down. He recommended a fine of $100.

Mr Tirikatene produced the boring pole in question and said he accepted responsibility for it coming adrift. He stated that he had just returned from campaigning the mare at Manawatu. He said that, while up there , he had purchased a new clip to replace one that had not come adrift once in the previous two years. The mare had raced twice at Manawatu with the new clip on the boring pole and tonight’s race was the first since then. It was a brand new clip and he did not know how it had come off.  He could not say it was faulty. He said that he prided himself on his attention to detail when gearing up the mare. Mr Tirikatene said that his driver informed him that the pole had become detached when the field was behind the gate.

The Committee, in determining penalty, had regard to Miss Puha’s admission of the breach and the submissions of both parties.

Miss Puha was fined the sum of $100.
