Facts:
Following the running of Race 3, Hornby Liquor Centre Mobile Trot, an Information instigating a protest was filed by Stipendiary Steward, Mr P Williams, against WESTLAND PEAK (R D Holmes), placed 5th by the Judge, on the ground that it “broke over the concluding stages being lapped onto by TRIXTON TIME (S E O’Reilly)” placed 6th.
Mr R D Holmes, trainer and driver of WESTLAND PEAK, had signed the Information form indicating that he did not contest the protest and that he did not wish to be present at the hearing of the Information.
The Judge’s placings were as follows:

Rule 870 provides:
(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation of the horse shall be at the discretion of the Judicial Committee.
Submissions for Decision:
Mr Williams showed a video replay of the final stages of the race. He pointed out WESTLAND PEAK, driven by Mr Holmes, go into a break, free of interference just short of the finishing line and continue on in a break to the finishing line, finishing in 5th position.
Mr Williams also pointed out that WESTLAND PEAK had been lapped on by TRIXTON TIME, placed 6th by the Judge. He sought relegation of WESTLAND PEAK to 6th placing behind TRIXTON TIME.
Reasons for Decision:
The Committee was satisfied that WESTLAND PEAK had gone into a gallop, free of interference, just prior to the finishing line and was in a gallop when its nose reached the finishing line. The Committee was further satisfied that it was clearly lapped on by the 6th placed runner, TRIXTON TIME, in its correct gait. Finally, the Committee noted that Mr Holmes did not contest the relegation of WESTLAND PEAK.
