DECISION AND REASONS:

--

Following the running of Race 9, First Sovereign Trust NZ Trotting Free-for-All, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr P C Nairn, alleging a breach of the push-out Rule in that Mr Nairn, as the driver of STIG in the Race, "forced POWER IN MOTION (T S Chmiel) wider on the track with approximately 1400 metres to run".

Mr Nairn was present at the hearing of the information and admitted the breach. The charge was found proved.

Mr N G McIntyre, Stipendiary Steward, showed the incident on video replays. He pointed out POWER IN MOTION in the two-out line with Mr Nairn inside against the markers. He then pointed out Mr Nairn come out on STIG and push POWER IN MOTION three-wide. Mr McIntyre submitted that it was clear that POWER IN MOTION was progressing forward and outside the wheel of STIG and was forced to race three-wide.

Mr Escott pointed out that the Race was a Group 1 event for a stake of $75,000. Mr Nairn had not breached the push-out Rule within the past 12 months. He recommended a fine of $450-500.

Mr Nairn stated that he had "pushed his luck a bit" thinking that Mr Chmiel was a half-length back. It was an error of judgement, he said. He had no submission to make in relation to penalty.

In determining penalty, the Committee took into account the following matters:

1. The status of the Race and the stake payable;

--

2. Mr Nairn’s very frank admission of the breach; and

--

3. Mr Nairn’s good record.

--

Having regard to the above, Mr Nairn was fined the sum of $450.
