DECISION AND REASONS:

Following the running of Race 5, Inter Island-Majestic Horse Float Transport Handicap Trot, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Junior Driver, Miss A D Edmonds, alleging that Miss Edmonds "used her whip excessively in the run home whilst driving ELLA POWELL".

Miss Edmonds, who was present at the hearing of the information, admitted the breach and was assisted by Licensed Open Driver, Mr M P Jones. The charge was found proved.

Mr N M Ydgren, Stipendiary Steward, showed a video replay of the final 300 metres of the Race. He pointed out Miss Edmonds on ELLA POWELL, wide on the track and towards the rear of the field, and he alleged that she had used her whip approximately 24 times in the run home. ELLA POWELL finished in 11th placing.

Mr Escott said that ELLA POWELL had been driven in complete contrast to her last two starts when she had been hit only occasionally in the run home. Mr Escott submitted that the Race was one at a premier meeting. He also informed the Committee that Miss Edmonds had breached the Rule on 29 December 2006 at Banks Peninsula and was suspended until 17 January 2007. He sought a fine of $500 or a 5-days suspension (15-20 drives).

Mr Jones submitted that some of the hits were with the reins. He further submitted that the recommended penalty was "quite harsh". While it was a premier day, he said, the stake ($20,000) was the same as for a C1 or C2 trot at Auckland. He said that Miss Edmonds would prefer a suspension to a fine.

Miss Edmonds agreed that her driving in the run home did not look good.

The Committee, in determining penalty took into account the following matters:

1. That the breach was at the higher end of the scale having regard to the number of times the whip was used and that ELLA POWELL had no chance of finishing in a stakes-bearing placing;

--

2. The need to deter Miss Edmonds from re-offending having regard to her previous breach of the rule within the last 12 months; and

--

3. Her admission of the breach.

Miss Edmonds’ licence was suspended from after 16 November 2007 up to and including 6 December 2007 – 5 days (including the premier meeting at Addington on 23 November 2007).
