Decision:
Following the running of Race 5, Mortlock McCormack Law Free-For-All Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against IDID IT MYWAY (C J De Filippi), placed 5th by the judge, on the grounds that it “broke in excess of 50 metres inside the final 200 metres”.
DECISION AND REASONS:
--Following the running of Race 5, Mortlock McCormack Law Free-For-All Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against IDID IT MYWAY (C J De Filippi), placed 5th by the judge, on the grounds that it “broke in excess of 50 metres inside the final 200 metres”.

Mr De Filippi, co-trainer and driver of IDID IT MYWAY, was not present at the hearing of the information but he had endorsed the information form “I do not contest the protest” and had signed it.

Mr N G McIntyre, Stipendiary Steward, showed a video replay of the final 200 metres of the Race. He pointed out IDID IT MYWAY break from its gait and continue in a gallop to the finishing line. Mr McIntyre pointed out the marker on the inside of the track marking the point 50 metres from the finishing line and it was clear that IDID IT MYWAY broke from its gait prior to passing that marker.

The Committee was satisfied that IDID IT MYWAY had broken from its gait within the final 200 metres of the Race and had failed to promptly regain its proper gait in terms of the Breaking Horses Regulation in that it had continued in a break for a distance of 50 metres or greater.

Accordingly, the protest was upheld and IDID IT MYWAY was disqualified from the Race. As a consequence of the disqualification, the amended placings for the Race are:
