The protest is upheld and Flyin Mandy is disqualified from the race.

Flyin Mandy finished 5th in the race. Accordingly, the first four placings remain as they were past the post 6, 8, 4, 9, 1 and 7.

Facts:

Following the running of the Euroblast 2YO Mobile Trot, an information instigating a protest was lodged by Chief Stipendiary Steward Mr N Ydgren against the fifth placing of Flyin Mandy on the grounds that it broke in excess of 50 metres inside the final 200 metres of the race in breach of the Breaking Horses Regulation.

The protest was not contested, disqualification accepted and Ms Chmiel confirmed to Mr Renault that she did not wish to appear at this hearing.

Rule 870(3) provides that “any horse which breaks from its gait during a race shall promptly return to its correct gait."

The Breaking Horses Regulations provide "that any horse which breaks from its gait and gallops in excess of 150 metres in a race shall be deemed to be in breach of Rule 870(3) and may be disqualified from the race."

Mr Ydgren replayed the race video and showed Flyin Mandy breaking for approximately 100 – 120 metres before returning to her gate near the finish line and completing the race. The length of the gallop was clearly in excess of 50 metres in the final 200 metres of the race.

Submissions for Decision:

Mr Ydgren submitted that Flyin Mandy was in breach of Rule 870(3) and should be disqualified from the race.

Reasons for Decision:

The Committee noted that Ms Chmiel did not contest the protest and disqualification must follow under the Rule.
