In light of Ms Cox’s admission of the charge and the clear video evidence of excessive use of the whip the breach was found proved.

Penalty:

Ms Cox is fined $200 for her excessive use of the whip on this occasion.

Facts:

Following the running of Race 1, the Christchurch Casino Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N Ydgren against Ms Cox, alleging a breach of Rule 869(2)(A), in that Ms Cox used her whip in an excessive manner in the final 400m when driving Machsgain.

Rule 869(2)(A) reads:

“No horseman shall…use his whip in an unnecessary, excessive or improper manner”.

Ms Cox admitted the charge in writing and attended the hearing where she confirmed her admission.

Through video evidence Mr Ydgren showed Ms Cox driving Machsgain entering the straight in fourth place, one off the rails, where she commenced the first of 11 clear strikes to her drive during the run home up the straight.

None of the strikes observed were hard and they were not rapid.

Submissions for Penalty:

Mr Ydgren submitted that Ms Cox had a clear record. In fact Mr Ydgren described Ms Cox’s record as exemplary and noting that she was a reasonably busy driver, who has started out as a trainer, that there was no reason to depart from the sliding scale of penalties under the JCA Penalty Guidelines and the relevant regulations and accordingly submitted that she be fined $200. Ms Cox emphasised that she had recently started out as a trainer, that she had a number of significant financial commitments including a mortgage and that if she could be forgiven this breach and any fine reduced she would be grateful.

After hearing the submissions of Mr Ydgren and Ms Cox and taking into account Ms Cox’s admission and overall record it is determined that she be fined $200 as per the guidelines and the relevant regulations.
