Facts:
Following the running of Race 1, the Dex, Greg, Mark – WDC Canada 2017 mobile trot (1950m), an information was laid by Stipendiary Steward Mr S Renault against Mr Edmonds, alleging a breach of Rule 869(2)(A), in that Mr Edmonds used his whip in an excessive manner in the final 400m when driving Unique Marshall.
Rule 869(2)(A) reads:
“No horseman shall…use his whip in an unnecessary, excessive or improper manner”.
Mr Edmonds admitted the charge in writing and indicated on the information that “I do not wish to be present at the hearing of this information”.
Through video evidence Mr Renault showed Mr Edmonds driving Unique Marshall entering the straight one off the rails, and then into the middle of the straight, where he commenced the first of 21 clear strikes to his drive during the run home up the straight. This included a rapid series of some 12 or so strikes commencing at approximately the 200m mark.
None of the strikes observed were hard (in the sense that Mr Edmonds used his wrist to generate power as opposed to his arm and/or shoulder); they were frequent however especially the rapid series of strikes referred to above (which were more in the nature of flicks of the wrist than strikes).
Submissions for Penalty:
Mr Renault pointed to Mr Edmonds’ record under the rules and in particular this rule. Mr Edmonds was fined $400 on 11 December 2016 at the Akaroa Trotting Club meeting being six months and one week prior to the date of this offending. Mr Renault acknowledged that because the Akaroa charge was more than six months ago, this charge cannot be classified as a second charge under the penalty guidelines. Accordingly, Mr Renault submitted that Mr Edmonds be dealt with by way of suspension (which was Mr Edmonds' indicated preference). Mr Renault submitted Mr Edmonds be suspended for three days noting he is a regular driver of approximately three to four horses per meeting.
Reasons for Penalty:
After hearing the submissions of Mr Renault and taking into account Mr Edmonds’ admission and overall record it is determined that he be suspended as proposed. Taking a starting point of three days as per the guidelines, there will be an increase of one day to mark the high end nature of the breach (especially the rapid series of strikes referred to above), before applying a discount of one day for his admission and for his record.
