DECISION AND REASONS:

--

Following the running of Race 7, the Colombus & Ware ? Menswear Specialists Handicap Trot an information was laid by Mr S. T. Larkins, Stipendiary Steward, against Mr S. Dickson the driver of "Prince Sundon", alleging a breach of the "push out" rule.

--

Mr Dickson had admitted the breach of the rule and confirmed this at the hearing.

--

A video of the incident was shown where the defendant had pushed "Sundon's Luck", driven by Mr K. D. Townley, wider on the track at about the 1300m mark.

--

PENALTY: Mr Larkins advised that the Mr Dickson had no previous relevant convictions. A fine of $200-00 was recommended.

--

The defendant had no submissions to make on penalty.

--

Having looked at previous penalties imposed for a breach of this rule I was satisfied that a fine of $200-00 was appropriate, and the defendant was fined the sum of $200-00.
