Facts:
Following the running of Race 12 an Information was filed by Chief Stipendiary Steward Mr N Ydgren alleging a breach of Rule 868(3) by Open Driver Mr M Purdon. The information stated: Mr Purdon (BELMONT MAJOR) failed to drive out to the finish.
Mr Purdon signed the information stating he admitted the breach and that he understood the rule.
Rule 868(3) provides as follows:
(3) every horseman shall drive his horse out to the end of the race if he has any reasonable chance of running first, second, third, fourth, fifth, or sixth.
Mr Ydgren assisted by Mr Williams used the race video to identify Mr Purdon driving (1) BELMONT MAJOR in the home straight 150 metres from the finishing post. He pointed to Mr Purdon being held up for a run and finally finding clear air with approximately 100 metres from the finish. He said Mr Purdon, once clear, showed some vigour but approaching the 50 metres and on to the finish showed none. Mr Ydgren said BELMONT MAJOR when clear, finished strongly and finished a close margin from 4th placing.
Mr Purdon said once he obtained a run, he slapped his horse but thought his race was over and he would be unable to figure in the finish. He was surprised the horse finished so close.
Submissions for Penalty:
Mr Ydgren said Mr Purdon had a clear record under this rule and together with his admission deserved some credit from the penalty guidelines.
Mr Purdon had no submissions to make on Penalty.
Reasons for Penalty:
The JCA Penalty Guidelines provides a fine or a suspension determined according to the placing lost. A breach involving 4th placing is a $400 fine or an 8-drive suspension.
The Committee having regard for the mitigating factors combined with the absence of any aggravating factors considered a $300 fine is an appropriate Penalty in this case.
