DECISION AND REASONS:
--Following the running of Race 7, Race Images Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against FULL OF FIRE (G R Payne), placed 1st by the judge, on the grounds of interference to ROYAL COURAGE (S P Walkinshaw), placed 10th by the judge, at the start.
----Mr Payne, the driver and a part-owner of FULL OF FIRE, was present at the hearing of the information and indicated that he was representing the connections of FULL OF FIRE in the protest.
----Mr Walkinshaw said that coming out of the gate (at the mobile 1950 metres start) he had eased and, as the gate left, Mr Payne's horse moved in slightly and Mr Payne's inside wheel clipped the hind leg of ROYAL COURAGE and touched its front leg causing it to go off stride and gallop. Prior to its breaking it had been "steering perfectly" and he had been pulling back off the gate. The horse was "put out of the race", he said. Mr Payne's horse may have "been hanging a bit" and had "drifted across" and just touched ROYAL COURAGE.
----Mr B D Williams, Assistant Stipendiary Steward, showed video replays of the start of the race. He pointed out ROYAL COURAGE drawn 4 behind the mobile barrier with FULL OF FIRE drawn outside it at 5. He acknowledged that in the best view, the head-on, the two horses concerned were partly obscured by the cab of the mobile vehicle. Mr Williams conceded that the alleged interference was difficult to see from any of the videos.
----Mr Payne used the video replays. He submitted that ROYAL COURAGE had already broken from its gait before any inward movement by his horse. He pointed out ROYAL COURAGE go into a break and, when the horses became visible, he pointed out that there was still a gap between the horses. He denied that there had been any contact.
----Mr McIntyre agreed that the video evidence was "inconclusive".
----After a deliberation, the Committee was not satisfied that it had been proved that there was interference by FULL OF FIRE to ROYAL COURAGE. The evidence given by the two drivers was conflicting and the video evidence was inconclusive but the Committee accepted, from its own observation of the video, that there was some credibility in Mr Payne's submission that ROYAL COURAGE had gone off stride of its own accord and prior to any inwards movement by FULL OF FIRE after the start. In any event, there was clearly considerable doubt as to what exactly had transpired and, in particular, whether ROYAL COURAGE had broken as a consequence of interference by FULL OF FIRE or for some other reason. It was conceded by both drivers and by Mr McIntyre that the video evidence of the incident was inconclusive.
----The protest was dismissed and the judge's placings for the race stand.
