Facts:
Following the running of Race 7, Express Electric Mobile Trot, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, against THE BOG (R T May), placed 4th by the judge, on the ground that THE BOG “broke over the concluding stages and was lapped on when finishing 4th”.
Mr N R McGrath, trainer of THE BOG, had endorsed and signed on the information form “I do not contest the relegation of THE BOG”. Mr Ydgren confirmed that Mr McGrath did not wish to be present at the hearing of the information.
Rule 870 provides as follows:
(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or horseman, then (subject to Rule 869 (8) such relegation of the horse shall be at the discretion of the Judicial Committee.

Mr Ydgren showed a video replay of the concluding stages of the race. He pointed out THE BOG, which had led for home, racing in 3rd position when it went into a gallop inside the final 50 metres. It continued in a gallop past the finishing line, finishing in 4th placing.
Mr Ydgren alleged that THE BOG had been lapped on by the runners from 5th back to 8th placing, TRIP’S ON ME. The judge’s margin between 4th and 8th was 1.9 lengths. The 9th placed runner, SUNCHITA, was 2.1 lengths behind THE BOG.
Mr Ydgren produced the official photo finish of the race which confirmed his allegation that THE BOG had been lapped on by the 5th, 6th, 7th and 8th placed runners.
Reasons for Decision:
The Committee was satisfied that THE BOG had broken from its gait, free of interference, inside the final 50 metres of the race, had continued on in a gallop and was not in its correct gait when its nose reached the finishing line. The Committee was further satisfied that THE BOG was lapped on by the 5th, 6th, 7th and 8th placed runners, each in its correct gait. We are required to relegate THE BOG to 8th placing.
