Decision: Following the running of Race 8, First Sovereign Trust Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Public Trainers, Mr D J & Mrs C M Butt, alleging that, as the trainers of CHARISTEAS in the Race, they “failed to affix the hopple strap as not to come adrift

DECISION AND REASONS:

Following the running of Race 8, First Sovereign Trust Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Public Trainers, Mr D J & Mrs C M Butt, alleging that, as the trainers of CHARISTEAS in the Race, they “failed to affix the hopple strap as not to come adrift on CHARISTEAS resulting (sic) the said runner being pulled up”.

Mr Butt had signed the Statement of Defendant endorsed on the information form indicating that, firstly, they admitted the breach of the Rule and, secondly, that they did not wish to be present at the hearing of the information.  The charge was found proved accordingly.

Mr B D Williams, Stipendiary Steward, on behalf of Mr McIntyre, stated that CHARISTEAS was the favourite for the Race. It had settled in a mid to rear position in the field, on the outer.  The hopple carrier strap came adrift causing the horse to gallop and lose all chance, eventually being pulled up.  Mr Williams said that he inspected the gear which he found to be in good condition but the strap had, clearly, come adrift. He recommended a fine of $100.

The Committee was satisfied that a fine of $100 was appropriate for this particular

breach of the Rule having regard to Mr & Mrs Butt’s admission of the breach and having regard to fines commonly imposed for breaches of the Rule.

Mr & Mrs Butt were fined the sum of $100.
