Following the running of Race 3 an information was lodged by Stipendiary Steward Mr S. T. Larkins against Mr C. J. De Fillipi alleging a breach of Rule 867 in that Mr De Fillipi drove Chris Riley over the final 60 metres of the race with his right foot out of the sulky rest.

DECISION AND REASONS:

--

Following the running of Race 3 an information was lodged by Stipendiary Steward Mr S. T. Larkins against Mr C. J. De Fillipi alleging a breach of Rule 867 in that Mr De Fillipi drove Chris Riley over the final 60 metres of the race with his right foot out of the sulky rest. Mr De Fillipi had indicated on the Information that he did not admit this breach of the rule and he confirmed this at the hearing.

Mr Larkins showed video coverage of this incident.

Mr De Fillipi gave evidence and did not dispute that he had taken his right foot out of the rest as shown on the video coverage. He said that he had done thise said that he H "unconsciously" when he was driving his horse out to the finish. Mr De Fillipi also stressed that he was not trying to use his foot as a bar. Mr Larkins accepted that this was so.

After the completion of the evidence we adjourned to consider our decision. The evidence and the video coverage was clear that Mr De Fillipi had taken his foot out of the rest and this is a breach of Rule 867. It does not have to be proved that Mr De Fillipi did this for any particular purpose. We were satisfied that this breach had been proved and we returned to the Enquiry Room and gave our decision.

PENALTY: Mr Larkins advised that Mr De Fillipi had a previous conviction on 8 April 2005 for an identical breach and that on that occasion he was fined the sum of $150-00. Mr Larkins recommended a fine of $200-00. Mr De Fillipi had no relevant submissions to make on penalty.

Taking all the above matters into account we considered that a fine of $200-00 was appropriate and Mr De Fillipi was fined this amount.
