Decision:

Following the running of Race 6, P Forty Seven Standing at Nevele R Stud Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Trainer, Mr  M A Cunningham, alleging a breach of Rule 864 (2) (d) in that Mr Cunningham, as the trainer of COURAGEOUS BEN, a runner in the Race, “failed to affix the near-side hopple strap as not to come adrift . . resulting in the gelding being pulled up”.



Following the running of Race 6, P Forty Seven Standing at Nevele R Stud Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Trainer, Mr  M A Cunningham, alleging a breach of Rule 864 (2) (d) in that Mr Cunningham, as the trainer of COURAGEOUS BEN, a runner in the Race, “failed to affix the near-side hopple strap as not to come adrift . . resulting in the gelding being pulled up”.

Rule 864 (2) (d) provides as follows:

--

864   (2)    Every horseman, owner, trainer and assistant thereof of a horse shall with regard    to that horse ensure that:-

--

           (d)  all gear is correctly applied and/or affixed so as not to malfunction or come   adrift.  

--

Mr Cunningham had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Mr McIntyre said that Mr P J Davis, the driver of COURAGEOUS BEN, had notified him on the horses returning to the birdcage that the near-side hopple strap had come undone. Mr McIntyre found the gear to be of good quality but, when he looked at it, found that the back side strap had not been put in its keeper properly which was the reason for what had happened. Mr McIntyre recommended a fine of $100.

Mr Cunningham was fined the sum of $100.
