Following the running of Race 2, the Ravenscar Farm Handicap Trot, an information was lodged by Stipendiary Steward Mr N. G. McIntyre against Mr K. Ford, Licensed Trainer of "Zuri" (7), alleging a breach of Rule 864(2)(d).

DECISION AND REASONS:

--

Following the running of Race 2, the Ravenscar Farm Handicap Trot, an information was lodged by Stipendiary Steward Mr N. G. McIntyre against Mr K. Ford, Licensed Trainer of "Zuri" (7), alleging a breach of Rule 864(2)(d). The charge reads as follows.

"I the abovenamed informant allege that the abovenamed Defendant committed a breach of Rule 864(2)(d) in that Trainer K. Ford failed to affix the sulky shaft on Zuri (M. P. Jones) as not to come adrift, resulting in Zuri being pulled up approx 1600m from the finish."

The rule reads as follows.

"(2) Every horseman, owner, trainer and assistant thereof of a horse shall

--

with regard to that horse ensure that :-

--

(a) ?.

(b) ?.

    3. all gear is correctly applied and/or affixed so as not to malfunction or come adrift."

Mr Ford had indicated on the information that he admitted the breach of this

--

rule and he confirmed that at the hearing.

--

Mr McIntyre gave evidence that the sulky shaft on "Zuri" came adrift during the race, and that it was fortunate that the driver, Mr M. P Jones, was experienced and able to pull the horse up and avoid what could have been serious consequences.

--

Mr Ford could not explain what had happened but accepted that the sulky shaft could not have been properly affixed.

--

Penalty: Mr McIntyre advised that Mr Ford had no previous convictions. It was recommended that a fine of $200-00 should be imposed in this case as there was a safety issue involved. It was also advised that "Zuri" was the favourite for the race.

--

Mr Ford had no relevant submissions to make regarding penalty.

--

After considering the matter of penalty, and after taking all the above matters into account, we were satisfied that a fine of $200-00 was appropriate in this case and Mr Ford was fined the sum of $200-00.
