DECISION AND REASONS:
--Following the running of Race 10, Christchurch Casino New Zealand Trotting Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Horseman, Mr A McCarthy, alleging that Mr McCarthy "used his whip excessively and /or withdrew his whip further back than the sulky seat when driving COBBITY CLASSIC out in the run home".
----Mr McCarthy was present at the hearing of the information and admitted the breach.
----Mr Knowles, Stipendiary Steward, showed a video replay of the final 300 metres of the Race. He pointed out Mr McCarthy trailing the leader WINFORU turning into the final straight. Mr Knowles alleged that Mr McCarthy used his whip 17 times on COBBITY CLASSIC in the home straight which he said was excessive because it was continuous and, also, that his whip action was above the shoulder and outside the confines of the sulky.
----Mr McCarthy acknowledged that his use of the whip did not look good. He further accepted that it was continuous but, he submitted, not continuous on the horse as he had been striking the shaft "three out of four times". He only struck the horse on the rump "a few times". He got excited in the heat of the moment, the race being the New Zealand Cup, Mr McCarthy said.
----Mr Escott produced Mr McCarthy's Australian driving record which disclosed no breaches of the whip Rule in the last 12 months. Mr Escott referred to the status of the Race and the stake payable. He recommended, having regard to the guilty plea, a fine of $400-500.
----Mr McCarthy did not wish to make any submissions in relation to penalty.
----In deciding penalty, the Committee took into account that the Race was Group 1 race for a stake of $500,000 ? New Zealand's premier event for pacers. The Committee also took into account Mr McCarthy's admission of the breach and his clear record over the last 12 months.
----Mr McCarthy was fined the sum of $450.00.
