Facts:
Following the running of the first Non Tote race, Australasian Breeders Crown Mobile Trot (Heat) for 2-year-old trotters, an information instigating a protest was filed by Stipendiary Steward, Mr C J Allison, against TWENTYTEN (M Purdon), placed 4th by the judge, on the grounds that TWENTYTEN “broke in excess of 50 metres in the final 200 metres of the race”.
The judge’s official placings were:
1st One Over Da Moon
2nd Daenerys Targaryen
3rd Mr Majestic
4th Twentyten
5th Cheeky Pat
Mr Purdon, trainer and driver of TWENTYTEN, had endorsed on the information form and signed “I do not contest the protest”. Mr Allison confirmed that Mr Purdon did not wish to be present at the hearing of the information.
Rule 869 provides as follows:
(4) Any horse which breaks from its gait in any race and:-
(a) which fails to promptly regain its proper gait . . . may (in addition to any penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horses Regulations made by the Executive, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.
The Breaking Horses Regulation provides as follows:
For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:
(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.
Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:
(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or
(ii) disqualify it from the race under Rule 1003 (2).

Mr Allison showed a video replay of the final 200-300 metres of the race. He pointed out TWENTYTEN, driven by Mr Purdon, racing in 3rd position go off stride just past the 200 metres and continue in a gallop for a distance, clearly, well in excess of 50 metres, eventually trotting across the line and finishing in 4th placing.
Mr Allison sought relegation of TWENTYTEN to 5th placing in the five-horse field.
Reasons for Decision:
The Committee was satisfied that TWENTYTEN had broken from its gait within the final 200 metres of the race and had failed to promptly regain its proper gait in breach of the Breaking Horses Regulation in that it galloped for a distance well in excess of 50 metres. It was appropriate that the horse be relegated from 4th placing.
