DECISION AND REASONS:
--Following the running of Race 1, Ecoholdings Media Group Mobile Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against ABCRADABRA (C D Thornley), placed 2nd by the judge, on the ground of a breach of Rule 869 (7B) in that it was "over the markers rounding the final bend".
----The connections of ABRACADABRA were represented at the hearing of the information by Mr Thornley, Mr M G Larter (Trainer) and Mr G D Wright (Part Owner).
----Mr Escott said that the Stipendiary Stewards were alleging that ABRACADABRA had gone over at least four pylons exceeding the distance specified in Rule 869 (7B). He told the Committee that Mr Thornley was of the opinion that he had been forced over the pylons by the horse outside him, FASTA GEE GEE (M P Edmonds).
----Mr N G McIntyre, Stipendiary Steward, showed video replays of the incident. He pointed out ABRACADABRA in the trail before the home turn with FASTA GEE GEE outside him. Mr McIntyre confirmed that ABRACADABRA's sulky wheel had gone over five track markers. Mr Thornley's horse had its head turned in but FASTA GEE GEE had its head turned down the track. Mr Edmonds "tracked down" onto the back of the leader INSIST (C J De Filippi) at that point. Mr McIntyre said that it was his belief that there was no pressure from Mr Edmonds initially but further on in the incident there appeared to be.
----Mr Thornley stated that he had been following INSIST. He had "brushed" the first pylon but Mr Edmonds had driven his horse down on top of him. Its head was pointing towards Mr Thornley. He demonstrated on the video replay that Mr Edmonds had gone down into the position where he, Mr Thornley, was supposed to be. Mr Thornley said that he had nowhere to go but over the pylons. Had there been a running rail, he would have been "on the deck", Mr Thornley said.
----At that point, Mr Escott sought leave of the Committee to withdraw the protest and leave was granted accordingly.
