DECISION AND REASONS:
--Following the running of the 1st Non Tote race, Australasian Breeders Crown 2YO Fillies Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr M P Jones, alleging that Mr Jones, as the driver of SCOTLYNN JANE in the race, "drove in a manner which interfered or was likely to interfere with another horse's (DONTDRINKTHENDRIVE) progress by failing to correct his horse's course in the run home".
----Mr Jones admitted the breach and, accordingly, the charge was found proved.
----The parties agreed to rely on the evidence and video evidence given at the earlier protest hearing.
----Mr McIntyre recommended a fine of $200.
----Mr Jones submitted that SCOTLYNN JANE had begun to run out when he pulled the earplugs. He submitted that he had done his best to keep it straight from that point. The horse had shown a tendency to run out in the straight in a previous start.
----Mr Jones was fined the sum of $200.
