NZ Metro TC - 14 August 2020
Meet Chair:
DAnderson
Race Date:
2020/08/14
Race Number:
R 7
Decision:
The protest was upheld and ANDOVERLOV was disqualified from the race.
Consequent upon the disqualification, the amended result is:
1st 6 AMERICAN PRIDE
2nd 10 JIMMY CARTER
3rd 9 ALADDIN SANE

It was ordered that the dividends and stakes be paid in accordance with the amended result.
Facts:
Following the running of Race 7 an information instigating a protest was filed by Stipendiary Steward Mr P Williams, against ANDOVERLOV (B Butt), placed 3rd by the Judge, on the grounds that it “galloped in excess of 150 metres over the early stages”.
Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its correct gait.
Relevant clauses from the Breaking Horse Regulations state: (a)
Any horse which breaks from its gait either at the start or during the running of any race and continues on in a break for a distance of 150 metres or greater shall be in breach of Rule 870 (3) in that it has failed to properly regain its proper gait.
Submissions for Decision:
Mr Williams with the assistance of Mr Ydgren, showed the race video and identified ANDOVERLOV drawn 4 at the mobile barrier. He pointed to ANDOVERLOV who begins well but shortly afterwards breaks from its gait, free of interference. Mr Williams contended ANDOVERLOV has continued on in a gallop for 165 metres.
Mr Williams pointed out to the Committee and Mr Butt the relevant track markers and their distances and calculated ANDOVERLOV had galloped for approximately 165 metres. After replaying the film several times there was mutual agreement between all parties with the sequence of events and the associated mathematics.
Mr Williams sought disqualification of ANDOVERLOV.
Reasons for Decision:
The Committee was satisfied that ANDOVERLOV had broken from its gait, free of interference, for approximately 165 metres in the early stages of the race, placed 3rd by the Judge, and therefore in breach of Rule 870 (3) and the Breaking Horse Regulation.
