DECISION & REASON
--Following the running of race 7 at the Metropolitan Trotting Club meeting on Friday 13th October 2006 the Stipendiary Stewards lodged an information against B & G Buchanan alleging a breach of Rule 834 (2) in that Live In Lover was a late scratching from race 7 at the meeting at 1.15 p.m. which was after the time prescribed for the meeting for the scratching of relevant horses.
----The Stipendiary Stewards had lodged the application but had been unable to have the matter served until racing at Methven today, 15th October 2006. The information was signed as being lodged by B Rabbitt, Registrar at the Metropolitan Trotting Club meeting on 13th October 2006.
----At the outset of the hearing the Committee noted that the Defendants had in writing admitted the breach of the rule and had advised in writing that they did not wish to be heard.
--The Stipendiary Stewards advised that the reason for the scratching of the horse was that it had been sold. As a consequence of the late scratching a horse on the ballot list had been denied a start in the race.

The Stipendiary Stewards confirmed that they sought a monetary fine only and accordingly a fine of $100 is imposed.
