DECISION AND REASONS:
--Following the running of Race 7, Mizone Rapid?Frucor Beverages Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Public Trainer, Mr T A Craddock, alleging that REAL BELLE (trained by Mr Craddock) "was presented without a tail tie that it raced in on the 6th July" in breach of "the 12-day rule".
----Mr Chmiel had accepted service of the information and represented Mr Craddock at the hearing. Mr Chmiel admitted the breach on behalf of Mr Craddock.
----Mr Ydgren informed the Committee that REAL BELLE had raced with a tail tie in its most recent start at Addington on 6 July and raced tonight in the same gear as last week, but without a tail tie. The gear changes list for tonight's meeting did not indicate that REAL BELLE would be racing without a tail tie.
----Mr Chmiel explained that he had been looking after the mare during the week and, when he geared the mare up prior to the race, there was no tail tie in the gear bag. His wife had ungeared the mare after last week's race and must have omitted to put the tail tie back in the bag, Mr Chmiel said.
----Mr Chmiel accepted the blame for the omission to fit the tail tie. Furthermore, he acknowledged that he was aware of the requirements of the Rule.
----In arriving at penalty, the Committee had regard to Mr Chmiel's admission of the breach on Mr Craddock's behalf and his explanation. Mr Ydgren acknowledged that the lack of a tail tie was unlikely to have affected the mare's performance in the race and, therefore, the betting public was not affected. The breach was at the lower end of the scale, in the Committee's view.
----Mr Craddock was fined the sum of $75.00
