DECISION AND REASONS:
--Following the running of Race 8 an information was laid by Stipendiary Steward Mr N. G. McIntyre, against Mr S. D. Lethaby the driver of "Regal Lustre" alleging that Mr Lethaby had committed a breach of Rule 869(3)(b) in that he drove carelessly when allowing Regal Lustre to shift out in the run home resulting in interference to Jays Debut (B. N. Orange).
------Mr Lethaby had indicated on the information that he admitted this breach of
--the Rules, and he did not wish to be present at the hearing.
--PENALTY: Mr McIntyre advised that Mr Lethaby had no previous relevant convictions, and recommended a fine in the range of $250 - $300. Mr McIntyre explained that his actions had caused his horse to be relegated and the chances of the favourite had been extinguished.
--The Committee then adjourned to consider penalty. We took into account Mr Lethaby's admission of the breach and his clean record. This case was comparable to the previous Charge against Mr Sharpe in which he was fined $250.00. However the Committee viewed this Charge as more serious as Mr Lethaby exposed another horse and driver to possible harm. Mr Lethaby is therefore fined the sum of $300.00.
