DECISION AND REASONS:

--

Following the running of Race 8 an information was laid by Stipendiary Steward Mr N. G. McIntyre, against Mr R. A. Sharpe the driver of "Fake Chance" alleging that Mr Sharpe had committed a breach of Rule 869(3)(b) in that he drove carelessly when allowing Fake Chance to shift out in the run home resulting in interference to Jays Debut (B. N. Orange).

Mr Sharpe had indicated on the information that he admitted this breach of

the Rules, and he confirmed this plea at the hearing. Mr Sharpe also agreed that the evidence from the protest hearing should form the basis for this hearing.

--

PENALTY: Mr McIntyre advised that Mr Sharpe had no previous relevant convictions, and recommended a fine in the range of $250 - $300. Mr McIntyre explained that his actions had caused his horse to be relegated and the chances of the favourite had been extinguished. Mr Sharpe told the Committee that the movement was mainly due to the gear the horse was wearing and that the interference was not intentional.

After a short deliberation and having taken into account Mr Sharpe's frankness and guilty plea together with his clean record we advised Mr Sharpe that he would be fined the sum of $250-00.
