The protest was upheld and STRESS FACTOR was disqualified from the race.

Consequent upon the disqualification, the amended result for the race is as follows:

Facts:

Following the running of Race 2, PGG Wrightson NZ Yearling Sales Series No.26 2YO Open Trot Final (Listed Race), an information instigating a protest was filed by Chief Stipendiary Steward, Mr N M Ydgren, against STRESS FACTOR (B Purdon), placed 4th by the judge, on the ground that it “broke for in excess of 150 metres on the final turn”.

Mr B Purdon, trainer and driver of STRESS FACTOR, had endorsed on the information form and signed “I don’t contest the protest”.

The judge’s official placings for the race were:

1st   6 One Muscle Hill
2nd  8 Springbank Lachie
3rd   5 Majestic Connies
4th   7 Stress Factor
5th   4 Paramount King

Rule 870 provides as follows:

(3) Any horse which breaks from its gait shall promptly regain its proper gait.

The Breaking Horses Regulation provides as follows:

For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:

(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:

(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or

(ii) disqualify it from the race under Rule 1003 (2).

Submissions for Decision:

Mr Ydgren showed a video replay of the race from about the 600 metres. He pointed out STRESS FACTOR, driven by Mr Purdon, trailing the leader, PARAMOUNT KING, as the field left the back straight. Shortly thereafter, STRESS FACTOR began to drift off the leader’s back and trot roughly and then went into a gallop, free of interference. The horse continued in a gallop for a distance in excess of 150 metres, Mr Ydgren submitted, with reference to the track markers. He sought disqualification of STRESS FACTOR.  

Reasons for Decision:

The Committee was satisfied that STRESS FACTOR had broken from its gait, free of interference, approximately 300 metres from the finish and had continued on in a gallop for some distance before finishing in 4th placing. The Committee was satisfied that STRESS FACTOR had galloped for a distance well in excess of 150 metres and had, therefore, failed to promptly regain its proper gait in breach of Rule 870 (3) and the Breaking Horses Regulation.

The Committee also noted that Mr Purdon did not contest the disqualification of STRESS FACTOR.
