Decision: Following the running of Race 4, the Kitchen ‘Things Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr R. D. Holmes, driver of “Lord Mamaduke” (6), alleging a breach of Rule 869(3)(b).  The charge was that Mr Holmes drove carelessly around the home bend for the first time

Following the running of Race 4, the Kitchen ‘Things Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr R. D. Holmes, driver of “Lord Mamaduke” (6), alleging a breach of Rule 869(3)(b).  The charge was that Mr Holmes drove carelessly around the home bend for the first time when shifting in onto “Seel The Dream” (A. Herlihy) resulting in that runner being checked.

Mr Holmes had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.  Mr Holmes also agreed that he understood the Rule and the charge.

In explanation Mr Holmes said that he thought he was clear when he shifted in.

Penalty:

In relation to penalty Mr Escott advised that Mr Holmes was fined $200-00 on 22 February 2008 and $250-00 on 25 April 2008 for breaches of this Rule.  Taking into account the previous convictions and also that this was a $20,000-00 race on a Premier Day, Mr Escott recommended a fine of $750-00.

Mr Holmes said he thought that the fine was excessive, but had no other relevant submissions to make relating to penalty.

We adjourned to consider the matter of penalty.  We took into account that this was a $20,000-00 race on a Premier Day, and that Mr Holmes had two convictions for careless driving in the last 12 months.  To Mr Holmes’ credit we took into account his guilty plea.  Taking all these matters into account we were satisfied that a fine of 750-00 was appropriate and Mr Holmes was fined this amount.
