DECISION AND REASONS:

Chief Stipendiary Steward, Mr N R Escott, filed an information with the Registrar on 8 November 2005 during the above meeting against Licensed Trainer, Mr M E Howard, alleging that M Howard had misconducted himself in that he "abused Club officials after being refused entry to the Bar adjacent to the Drivers' room. The abuse taking place in the foyer at 7.14pm."

The information was served on Mr Howard on 10 November 2005 at the meeting of Ashburton Trotting Club at Ashburton. Mr Howard signed the Statement by the Defendant on the information acknowledging service of the information, admitting the breach and indicating that he did not wish to be present at the hearing of the information.

The charge was found proved.

Mr Escott informed the Committee that he and other Stipendiary Stewards had been standing in the birdcage and noticed an incident in which voices were raised at the door exiting the foyer. Mr Escott said that he approached and discovered Mr Howard, a licenceholder, "debating the pros and cons" with two security personnel and Mr M K Campbell, the Marketing and Development Manager of the Club. Other Committee members of the Club were also present as were members of the public. Mr Escott said that he told Mr Howard on two occasions to back off and leave. His language was unbecoming, Mr Escott said, of a licenceholder. As Mr Howard departed, he said: "I will read the result in the fucking paper".

Mr Escott then said that he got hold of Mr Howard at the Ashburton meeting on 10 November. He expressed remorse for what had transpired but he had refused to apologise and leave at the time of the incident.

Mr Escott said that he informed Mr Howard that he had charged him and would be recommending to the Judicial Committee a fine of $500. He was taking Mr Howard at his word to apologise to the people concerned.

The Committee accepted that a fine of $500 was appropriate and Mr Howard was fined the sum of $500.
