Following the running of Race 11, Ice Bloodstock Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Trainers, J P Green and B Hughes, alleging that Messrs Green and Hughes, as the trainers of MATTER OF PRIDE in the race, committed a breach of Rule 864 (2) (d)

DECISION AND REASONS:

--

Following the running of Race 11, Ice Bloodstock Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Trainers, J P Green and B Hughes, alleging that Messrs Green and Hughes, as the trainers of MATTER OF PRIDE in the race, committed a breach of Rule 864 (2) (d) in that the boring pole on MATTER OF PRIDE came adrift during the running.

The information was filed with the Registrar on 8 November 2005 and was adjourned sine die pending service of the information on the Defendants. The information was served during the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on 11 November 2005.

Mr Green attended at the hearing of the information and admitted the breach. The charge was found to be proved.

Mr Green submitted that the gear had been properly affixed. The boring pole had come apart in the middle when the horse turned its neck. MATTER OF PRIDE is a big horse with a long neck. The part of the pole without the burr that is affixed to the saddle came loose after that and the boring pole was "flapping around". He submitted that it was not a fault on the part of the trainers in affixing it. Mr Green submitted that the chances of MATTER OF PRIDE had not been affected. He said that it was the first time that had happened to a horse trained by him.

Mr McIntyre recommended that a fine of $200 be imposed

Messrs Green and Hughes were fined the sum of $150.
