DECISION AND REASONS:
--Following the running of Race 11, Lindauer New Zealand Free-For-All, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Trainer, M J House, alleging that Mr House, as the trainer of BELLA?S BOY in the race, failed to affix the boring pole on BELLA?S BOY as not to come adrift.
--Mr House had signed the Statement by the Defendant endorsed on the information form acknowledging service of the information on him and indicating that he admitted the breach of the Rule and, further, that he did not wish to be present at the hearing of the information.
--The charge was found proved.
--Mr McIntyre recommended that a fine of $200 be imposed, pointing out the status and stake of the race ? a Group 1 race for a stake of $100,000. He showed a video replay in which it was pointed out that the boring pole on the near side of BELLA?S BOY had come adrift with approximately 600 metres to run.
--It was confirmed that the recommended fine had been discussed with Mr House prior to his signing the information form.
--Mr House was fined the sum of $200.
