Following the running of Race 1, Smokefree Graduation Mobile Pace (Final), an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against CHIVALROUS (C J De Filippi), placed 4th by the judge, on the grounds of interference to MIDNITE (A M Butt) rounding the final bend.

Mr S A Ballantyne, trainer of CHIVALROUS, represented the owner of that horse. Mr De Filippi was also present.

Mr Butt stated that he was initially on the fence but moved out to the 2-out line. Mr De Filippi was ahead of him and in the 3-wide line. The horse that Mr De Filippi was following was under pressure and Mr De Filippi angled back down off its back into the 2-wide line. As he did so, Mr Butt said that he had to take hold to get out of the gap. If he had not taken hold he would have been tightened. Mr Butt said that Mr De Filippi had moved down but it was a "racing incident". Both horses had been going for the same gap but his progress was possibly impeded, Mr Butt said.

Mr Escott had Mr B D Williams, Deputy Stipendiary Steward, show the incident on video replays. He pointed out MIDNITE improve from back on the pylons into the middle immediately inside CHIVALROUS. Mr De Filippi was initially on J F Curtin's back in the 3-wide line ? he moved back in simultaneously with Mr Butt improving into the gap, which was vacant and both drivers were attempting to fill. Mr Butt took a hold when the gap closed and, as a result, his horse broke.

Mr De Filippi confirmed that he was in the 3-wide line and the horse in front of him was stopping. The horse inside was stopping also and had left a gap. He submitted that he eased into the gap at the same time as Mr Butt was easing off the markers. He stated that, once he was committed to come off Mr Curtin's back, he was committed to take the gap. Mr De Filippi confirmed that there had been no contact. Mr De Filippi referred to the videos.

Mr Butt admitted that MIDNITE had broken in the run up and is not "the most perfect pacer". He said that, initially, Mr De Filippi had come in and he, Mr Butt, had come back and his horse had not broken to start with. He had run out slightly when Mr Butt took hold of him ? this was slightly after Mr De Filippi's initial movement in.

Mr De Filippi submitted that he was entitled to push Mr Butt down as there was no horse inside Mr Butt. He alleged that Mr Butt had come out at the same time as he moved back down. He had not eased back, rather eased down. The 2-out line was the only line progressing forward.

At that point, Mr Escott sought the leave of the Committee to withdraw the protest. Leave was granted accordingly.
