Information No. 67801 alleged that Licensed Public Trainer, Mr A C White, presented HOME TOWN HERO, trained by him, in the assembly area prior to Race 8, Continental Event Hire Mobile Pace, without the pull down blinds that it raced in on 30 November 2008 at the Banks Peninsula Trotting Club meeting.



DECISION AND REASONS:

Information No. 67801 alleged that Licensed Public Trainer, Mr A C White, presented HOME TOWN HERO, trained by him, in the assembly area prior to Race 8, Continental Event Hire Mobile Pace, without the pull down blinds that it raced in on 30 November 2008 at the Banks Peninsula Trotting Club meeting.

Mr White had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Rule 865 provides as follows:

--

(1)     Subject to Rule (2) and (3), every horse shall race with the same or identical gear within a 12 day period.

--

(4)     The trainer and/or person in control of a horse shall present such horse in the assembly area with the same or identical gear, or with such different gear as has been notified to the Secretary, as required by the foregoing provisions of this Rule.

The Committee considered the matter of the period encompassed by the 12-day Rule in the context of this particular breach. It was the Committee’s view that the reference to the 12 day period in the Rule does not include either the day of the previous meeting or the day on which the horse is next presented to race. On that basis, in this case, the 12 day period would have expired at midnight on 12 December. The breach in this case, therefore, took place on the 11th day of the 12 day period.

Mrs Williams, on behalf of Mr Renault, recommended a fine of $100.

Mr White was fined the sum of $100.
