Following the running of Race 1, the Vero Insurance Mobile Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Messrs G. T. and P. T. Court, the licensed trainers of “Nomore Mr Niceguy” (7), alleging a breach of Rule 849(2). It was alleged that the defendants presented this horse with an incorrectly numbered saddle cloth.

Following the running of Race 1, the Vero Insurance Mobile Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Messrs G. T. and P. T. Court, the licensed trainers of “Nomore Mr Niceguy” (7), alleging a breach of Rule 849(2). It was alleged that the defendants presented this horse with an incorrectly numbered saddle cloth.
--Mr P. T. Court attended the hearing and he confirmed that this breach of the Rules was admitted. Mr Court also agreed that he understood the charge and the Rule it was brought under.
--Mr Ydgren gave evidence that it was noticed that the horse was wearing saddlecloth (6) as it was about to go on to the track. The matter was then rectified.
--Mr Court agreed with the facts of the matter, and explained that they had two horses entered tonight, with numbers (6) and (7), and that they had been switched by mistake.
--Penalty:
--Mr Ydgren said that Messrs Court had no previous convictions under this Rule and recommended a fine of $150-00, which was the amount recommended by the Sentencing Guide.
--Mr Court made submissions that the amount recommended was excessive.
--We adjourned to consider the matter of penalty. We looked at fines imposed in similar circumstances for a breach of this Rule and we were satisfied that a fine of $150-00 was appropriate in these circumstances. Accordingly Messrs G. T. and P. T. Court were fined the amount of $150-00.
