Following Race 2, The Edge Public Village on Sale-addington.co.nz Mobile Trot, an information was lodged against Licensed Open Horseman, Mr R Houghton, alleging a breach of Rule 869(2) in that he used his whip on more occasions than is permitted inside the final 400m.
Mr Houghton confirmed that he admitted the charge.
Mr Renault gave evidence to show that Mr Houghton driving TAKE AFTER ME, was positioned in the lead as the field passed the 400m. Shortly afterwards, Mr Houghton, drew the whip and used it on 13 occasions prior to the line.
Mr Houghton did not dispute the number of strikes.

Mr Houghton’s record was clear of any breaches under this rule in the previous 6 months therefore as a first offence, the sliding scale, 11-13 strikes, being a $200 fine, as per the JCA Penalty Guide, was adopted. There were no aggravating factors to consider therefore no uplift was warranted.
With mitigation inclusive under the sliding scale, a fine of $200 was determined an appropriate penalty.
