Decision: Following the running of Race 3, the CTOA Cup Week Golf Tournament Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr T. M. Williams, driver of “Westburn Talent” (3), alleging a breach of Rule 869(3)(b). The charge was that Mr Williams drove carelessly after entering the straight for the run home
Following the running of Race 3, the CTOA Cup Week Golf Tournament Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr T. M. Williams, driver of “Westburn Talent” (3), alleging a breach of Rule 869(3)(b). The charge was that Mr Williams drove carelessly after entering the straight for the run home when he allowed his horse to strike the sulky wheel of a horse in front of him, resulting in his horse falling.

Mr Williams had indicated on the information that he admitted this breach of the Rules and he and Mr Dunn confirmed that they understood the Rule and the charge.

Video coverage of this incident was shown. Mr Williams explained that he was looking to improve on the outside of the horse in front of him at the time of the incident. However this run did not eventuate and he decided to go on the inside. His horse was going very well, and as he made the change of direction his horse struck the sulky wheel of “Living Blue Boy”.

In relation to penalty Mr Escott advised that Mr Williams had a previous conviction on 18 July 2008 under Rule 869(4) – driving in a manner likely to cause interference. Mr Williams was asked if he would prefer a suspension to a fine, but he did not. Mr Escott recommended that a fine of $400-00 would be appropriate in this case.

Mr Williams and Mr Dunn had no relevant submissions to make regarding the quantum of the fine.

I was satisfied that a fine of $400-00 was appropriate in the circumstances of this case, and Mr Williams was fined this amount.
