Ms Laing had signed the Statement by the Defendant on the information form indicating, firstly, that she admitted the breach and, secondly, that she did not wish to be present at the hearing of the information. The charge was, accordingly, found proved.

Rule 869 provides as follows:
(2)   No horseman shall during any race:-
      (a)  use his whip in an unnecessary, excessive or improper manner.

A video replay of the Race from the straight entrance was shown to the Committee by Stipendiary Steward, Mr N G McIntyre. Ms Laing’s actions were pointed out and it was alleged that she had used her whip approximately 22 times in the run home. Mr McIntyre acknowledged that there had been some short pauses but, he said, to use the whip on 22 occasions in the run home was, simply, too much.

Mr Escott informed the Committee that Ms Laing had not breached the whip Rule in the previous 12 months. He recommended a fine of $200.

The Committee took into account Ms Laing’s admission of the breach and her previous good record.

--

Ms Laing was fined the sum of $200.
