Decision: Following the running of Race 6, the Avon City Ford Pace, an information was laid by Chief Stipendiary Steward Mr Escott against Mr M. J. Howard, the driver of “Franco Radial” (3), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively in the run home.

Mr Howard had indicated on the information that he admitted this breach of the Rule and also that he did not wish to attend the hearing.

Video coverage of this incident was shown to illustrate that Mr Howard had used his whip on about 25 occasions in the run home, and that this use was almost continuous.

In relation to penalty Mr Escott advised that Mr Howard had no previous convictions, and a fine of $200-00 was recommended.

In deciding an appropriate penalty we took into account that the recommended starting point for a breach of this Rule is a fine of $250-00. We took into account that Mr Howard has no relevant previous convictions and also his admission of the breach. For all the above reasons we were satisfied that a fine of $200-00 was appropriate in the circumstances. Accordingly Mr Howard was fined the sum of $200-00.
